1. Parties

This agreement is between:

  • Whale Digital— CNPJ: 41.896.274/0001-98, headquartered at João Pessoa, Paraíba, Brasil ("Whale Digital", "we");
  • User — any individual or entity accessing whaledigital.com.br.

2. Services

whaledigital.com.bris an informational website presenting Whale Digital's B2B services, including:

  • Custom software development
  • Technical consulting and digital project management
  • Digital performance management (Google Ads, Meta Ads, paid media)
  • Other technology and digital marketing services

Contracted services are governed by separate written agreements between the parties. Accessing this website does not constitute a service agreement.

3. Acceptable Use

Access is permitted for legitimate informational and commercial purposes. Prohibited uses include:

  • Illegal, fraudulent, or third-party rights-infringing activities;
  • Unauthorized automated data collection (scraping) without prior written consent from Whale Digital;
  • Attempting to compromise the security, integrity, or availability of the site;
  • Reproducing, distributing, or commercially exploiting site content without authorization (see Section 5).

4. Disclaimer

The site is provided "as is." Whale Digital:

  • Does not guarantee uninterrupted availability or the absence of technical errors;
  • Is not liable for the accuracy or currency of informational content;
  • Is not liable for indirect damages, lost profits, or losses arising from use of information on the site.

Service-specific responsibilities are defined in individual contracts.

5. Intellectual Property

All site content — including text, images, logos, trademarks, source code, layout, and design — is owned by or licensed to Whale Digital, protected under:

  • Law No. 9,610/1998 (Brazilian Copyright Act);
  • Law No. 9,279/1996 (Brazilian Industrial Property Act).

Any reproduction, distribution, adaptation, or commercial use, in whole or in part, without prior written authorization from Whale Digital is prohibited.

The site may link to third-party websites. Whale Digital is not responsible for their content, availability, or privacy practices.

7. Communications

By submitting the contact form, you authorize receipt of a response related to your request. Marketing communications comply with the Brazilian Internet Act (Law No. 12,965/2014) and LGPD (Law No. 13,709/2018), requiring prior consent where applicable.

9. Governing Law and Jurisdiction
